TUPL AGRO, S.L.U. (hereinafter TUPL AGRO) has developed a platform that provides products and services in the agricultural sector.
TUPL AGRO attributes the condition of User to anyone who makes use of the Platform. TUPL AGRO grants the option to the User of being able to register or not to the platform. Nevertheless, there are services of the Platform that will only be available for the registered Users that contract the Products and Services of TUPL AGRO.
TUPL AGRO maintains a responsible action and is conscious of the importance of the privacy, reason why it assumes the responsibility to fulfill the effective legislation in the matter of protection of data and according to the principles of this norm.
TUPL AGRO reserves the right to modify the present Privacy Policy to adapt it to the legislative, jurisprudential innovations or of interpretation of the Spanish Agency of Protection of Data (AEPD) and/or of the procedures or purposes of treatment of its data. To such effect, TUPL AGRO will previously notify or announce the changes made, indicating in a transparent manner and with due notice the modifications made, and requesting, if necessary, your acceptance of the same. TUPL AGRO will not make retroactive changes that reduce your rights unless legally required by the processes we have put in place to protect your data.
In accordance with the above and with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and the Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD); TUPL AGRO in its capacity as data controller, informs you of the processing carried out on the personal data you provide and on which the security, technical and organizational measures provided for in the regulations in force are applied.

TUPL AGRO treats your data in order to offer the services of its Platform and, in particular, to:
The processing of data for purposes other than those detailed above will require a legitimate basis or prior explicit consent in each case.
The legal basis for the processing of your data is your consent to send commercial communications.
The legal basis for the processing of your data is the execution of the Contract signed with TUPL AGRO or for the application of pre-contractual measures if you are a registered user or contract products or services from the platform.
In legitimate interest TUPL AGRO will treat data of the natural persons and/or individual entrepreneurs that are necessary to the object of the Contract, treating only the minimum data for its professional location and only with the purpose of maintaining the relation with respect to the contract subscribed with the legal person in which the affected one works and/or renders your services.
Likewise, the legal basis for the elaboration of statistics will be the legitimate interest of TUPL AGRO. The processing of your data based on legitimate interests will be carried out, in any case, with the utmost rigor and respect for your privacy, rights and freedoms; and in no way that might be used for purposes that undermine your rights in this regard.
The processing of your data for the purposes set out in the previous paragraph and which are based on the consent requested may be revoked at any time, but in no way the withdrawal of this consent might condition the execution of the contract signed, given the case, with TUPL AGRO.
No communication of data to third parties is foreseen, except for legal obligation or prevention of illicit actions. However, if such a possibility is contemplated, TUPL AGRO will request your consent.
Without prejudice to the above, TUPL AGRO informs you that the provision of some of its services or supply of products, require access by third parties to their data and TUPL AGRO undertakes to comply with the provisions of applicable legislation. For these purposes, TUPL AGRO informs you that will carry out data treatment requests to third parties such as cloud storage services, logistics or courier services, or services with third party companies with which this entity has agreements such as legal and / or tax advisors.
In principle, international data transfers are not foreseen. However, in the event that TUPL AGRO's activity requires transferring your data to a third country outside the European Union or that does not have an adequate level of protection as declared by the European Commission, it will adopt the appropriate guarantees to carry out such international transfers in accordance with the applicable legislation in force or, where appropriate, will request your express consent.
Any person has the right to obtain confirmation as to whether TUPL AGRO is processing personal data concerning him/her or not.
You can also exercise the rights conferred by current legislation: right of access, rectification, deletion and opposition, limitation of processing, data portability and not to be subjected to automated individualized decisions.
You also have the right to withdraw your consent at any time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.
You can exercise your rights by any means that allows accrediting the sending and receipt of your request. The request will have to be addressed to TUPL AGRO through the data that are included in the section of "Responsible for the Treatment", indicating the reference "Data Protection". The request must include: Name, surname(s) and photocopy of your ID, base in which your request is demanded and address for the purpose of notifications.
In case of not being satisfied with the answer of TUPL AGRO, before the exercise of your rights you have the right to claim before the Authority of Control (Spanish Agency of Protection of Data) the protection of the same ones.
The personal data object of treatment by TUPL AGRO have been provided by yourself by filling in the corresponding forms of the Platform or because they have been communicated by third entities (agricultural cooperatives, companies, employers, etc.) with which TUPL AGRO has signed the appropriate agreements and provided that you have given your consent for this purpose if this was the basis of legitimacy. The User guarantees that he/she is of legal age or over fourteen years of age to give his/her consent in accordance with the current regulations on data protection and that the data provided are true, accurate, complete and up to date, being responsible for any damage or loss, direct or indirect, that may be caused as a result of the breach of such obligation.
TUPL AGRO informs you that it will treat and store your data as long as it is necessary for the execution of the Contract and it is in force and in order to be able to use them in accordance with the purpose and legal basis of the treatment for which they were collected and provided that you do not revoke your consent. We will also process your data to comply with the requirements of applicable law, prevent unlawful actions, resolve disputes, troubleshoot problems, perform our contract and other actions permitted by law. Once the Contract is terminated, we will keep your personal data for the legal statute of limitations periods, in accordance with current applicable Tax, Civil and Commercial law.
Once the processing of your data is no longer necessary and the legal limitation periods have elapsed, we will delete and/or block them in accordance with our data retention and deletion policy.
TUPL AGRO will adopt the security measures that are appropriate to avoid the alteration, loss, treatment or unauthorized access of data. Likewise, it will inform whoever has access to your data about its obligations of security, confidentiality and its duty to keep secret.
TUPL AGRO carries out the treatment of your data under security levels. To these effects, the transactions of credit card will be transmitted through a safe server SSL (Secure Socket Layering). When the letters "http" change to "https", the "s" means that you are in an SSL area; your browser may also inform you of the security of the site by means of a pop-up message. The SSL security protocol encrypts personal information during data transport.
Notwithstanding the foregoing, the security of information transmitted over the Internet cannot be guaranteed. In this regard, TUPL AGRO cannot be held responsible for any interception or interruption of communications over the Internet or for changes to or loss of information. Users of the Platform are responsible for maintaining the security of any password, user name or any other form of identification to gain access to password-protected areas of any of our services. In order to protect your data and information, we may suspend the use of any of TUPL AGRO's services, without notice, if a breach or breach of security is suspected.
